1. **Compliance with Privacy Act:** In providing the Goods and/or Services, the Supplier must comply, and ensure that its officers, employees, agents, and subcontractors comply with the **Privacy Act 1988 (Cth)**. The Supplier shall not do anything that would breach an **Australian Privacy Principle** as defined in that Act.
2. **Notification of Required Disclosures:** If the Supplier becomes aware that it may be required to disclose **Personal Information** by law or to the **Australian Information Commissioner**, it must promptly notify the Customer in writing (within 3 days).
3. **Suspected or Actual Data Breach:** If the Supplier suspects there may have been an **Eligible Data Breach** related to any Personal Information held under the Contract, it agrees to:
  • Notify the Customer in writing as soon as possible (within 3 days).
  • Cooperate with the Customer and law enforcement in accordance with applicable law.
  • Assist the Customer in assessing and addressing the breach.
4. **Ongoing Obligations:** The Supplier must keep the Customer informed of any breaches or potential breaches of its obligations under this clause.
5. **Audit Rights:** The Customer has the right to access records and premises of the Supplier to monitor compliance with the Privacy Act.
